However, it may assume broader responsibilities if it substantially modifies the system, integrates it into one of its own products or markets it under its own brand.\n<\/p>\n<\/div>\n<\/section>\n<section id=\"digital-omnibus\" aria-labelledby=\"digital-omnibus-title\">\n<h2 id=\"digital-omnibus-title\">What Has Been Postponed by the Digital Omnibus?<\/h2>\n<p>\nThe Digital Omnibus has amended the implementation timeline for certain provisions relating to high-risk AI systems.\n<\/p>\n<p>\nThe postponement mainly concerns the specific obligations applicable to AI systems classified as high risk. Organisations should use the transitional period to prepare in a structured way, ensuring that appropriate processes, responsibilities and documentation are in place well before the new deadlines.\n<\/p>\n<p>\nThis means identifying the AI systems currently in use, classifying their use cases, determining which may fall into the high-risk category, assessing AI providers, defining internal responsibilities and progressively preparing the documentation needed to demonstrate compliance.\n<\/p>\n<p>\nThe postponement applies only to specific obligations under the AI Act. Other applicable legislation remains fully in force, including the GDPR, employment law, consumer protection rules, intellectual property law, product safety requirements and contractual obligations.\n<\/p>\n<\/div>\n<\/section>\n<section id=\"chatbots-assistants\" aria-labelledby=\"chatbots-assistants-title\">\n<h2 id=\"chatbots-assistants-title\">Chatbots and Virtual Assistants: What Must Be Disclosed?<\/h2>\n<p>\nWhenever a person interacts directly with an artificial intelligence system, they must be informed that the interaction is with AI, unless this would already be obvious to a reasonably well-informed and reasonably observant person.\n<\/p>\n<p>\nThis requirement may apply to:\n<\/p>\n<ul class=\"htt-check-list\">\n<li>chatbots embedded in websites;<\/li>\n<li>virtual customer support assistants;<\/li>\n<li>AI-powered voicebots;<\/li>\n<li>AI assistants integrated into e-commerce platforms and customer portals;<\/li>\n<li>digital avatars interacting with users;<\/li>\n<li>AI agents that collect requests or provide recommendations.<\/li>\n<\/ul>\n<h3>How should users be informed?<\/h3>\n<p>\nThe information should be clear, timely and easy to understand. It should be presented no later than the beginning of the user&#8217;s first interaction with the AI system.\n<\/p>\n<div class=\"htt-highlight-box\" role=\"note\" aria-labelledby=\"chatbot-copy-title\">\n<h3 id=\"chatbot-copy-title\">Example of a chatbot disclosure<\/h3>\n<p>\n<strong>You are interacting with an AI-powered virtual assistant.<\/strong> Responses may be generated automatically and could contain inaccuracies. If your request requires human review, please contact our customer support team.\n<\/p>\n<\/div>\n<p>\nSimply hiding this information in the privacy policy or the website&#8217;s terms and conditions is not sufficient. <strong>Users should be able to recognise immediately that they are not communicating with a human.<\/strong>\n<\/p>\n<h3>Is a disclosure always required?<\/h3>\n<p>\nA specific disclosure may not be necessary when the artificial nature of the system is already obvious\u2014for example, if the chatbot is clearly presented as an AI assistant through its name, visual appearance or interface. However, to avoid ambiguity and provide a better user experience, an explicit disclosure is generally the safest and most transparent approach.\n<\/p>\n<\/section>\n<section id=\"ai-generated-content\" aria-labelledby=\"ai-generated-content-title\">\n<h2 id=\"ai-generated-content-title\">AI-Generated Content: Machine-Readable Marking and Detectability<\/h2>\n<p>\nArticle 50 requires providers of AI systems capable of generating synthetic content to implement technical measures ensuring that AI-generated or AI-manipulated outputs can be detected as such.\n<\/p>\n<p>\nThe marking should be:\n<\/p>\n<ul class=\"htt-check-list\">\n<li>effective;<\/li>\n<li>interoperable;<\/li>\n<li>robust;<\/li>\n<li>reliable;<\/li>\n<li>technically feasible;<\/li>\n<li>machine-readable.<\/li>\n<\/ul>\n<p>\nThis responsibility primarily lies with the developers and providers of generative AI systems. It does <strong>not<\/strong> mean that every company using an AI tool must develop its own watermarking technology.\n<\/p>\n<p>\nHowever, organisations using AI should verify whether the selected platform supports content provenance technologies such as technical marking, provenance metadata or other identification mechanisms.\n<\/p>\n<h3>Is the technical marking always visible?<\/h3>\n<p>\nNo. A machine-readable marking may be embedded in metadata, incorporated into the file itself or applied through techniques that are not immediately visible to the human eye.\n<\/p>\n<p>\nIt should therefore not be confused with a simple text label such as <strong><em>AI-generated image<\/em><\/strong>.\n<\/p>\n<figure class=\"htt-article__figure\" aria-labelledby=\"figure-c2pa-caption\">\n<p><img decoding=\"async\" src=\"https:\/\/www.htt.it\/wp-content\/uploads\/2026\/01\/test-1-1024x765.png\"\nalt=\"Example of technical content provenance marking using C2PA\"\nwidth=\"1200\"\nheight=\"675\"\nloading=\"eager\"\nfetchpriority=\"high\"\ndecoding=\"async\"\n><figcaption id=\"figure-c2pa-caption\">\nExample of technical content marking. aria-labelledby=\"two-levels-transparency-title\">\n<h3 id=\"two-levels-transparency-title\">Two Different Levels of Transparency<\/h3>\n<p>\nCompliance may require both a <strong>machine-readable technical marking<\/strong>, typically implemented by the AI system provider, and a <strong>human-readable disclosure<\/strong>, which may be required in specific situations for the person or organisation publishing or using the content.\n<\/p>\n<\/div>\n<\/section>\n<section id=\"deepfake\" aria-labelledby=\"deepfake-title\">\n<h2 id=\"deepfake-title\">Deepfakes: When Is AI Disclosure Mandatory?<\/h2>\n<p>\nThe AI Act defines a deepfake as an image, audio or video content generated or manipulated by artificial intelligence that resembles real persons, objects, places, entities or events and could falsely appear authentic or truthful.\n<\/p>\n<p>\nAnyone using an AI system to generate or manipulate a deepfake and subsequently making it available to others must clearly disclose that the content has been artificially created or altered.\n<\/p>\n<p>\nThe disclosure should be clear, distinguishable and provided no later than the moment the content is first presented to the public.\n<\/p>\n<h3>Examples of content that may fall within these requirements<\/h3>\n<ul>\n<li>videos in which a person appears to say words they never actually spoke;<\/li>\n<li>audio recordings that imitate the voice of a real individual;<\/li>\n<li>photorealistic images depicting events that never occurred;<\/li>\n<li>AI-generated recreations of public figures;<\/li>\n<li>promotional content in which real endorsers are artificially recreated;<\/li>\n<li>realistic representations of non-existent places or products presented as authentic.<\/li>\n<\/ul>\n<figure class=\"htt-article__figure\" aria-labelledby=\"figure-fake-news-caption\">\n<p><img decoding=\"async\" src=\"https:\/\/www.htt.it\/wp-content\/uploads\/2024\/07\/fake-1024x1024.webp\"\nalt=\"Example creative works<\/h3>\n<p>\nFor content that is clearly artistic, creative, satirical or fictional, the disclosure requirement should be applied in a way that does not unnecessarily interfere with the enjoyment or understanding of the work.<br \/>\nWe previously explored this topic in our article on <a be indicated in an appropriate manner.\n<\/p>\n<div class=\"htt-highlight-box\" role=\"note\" aria-labelledby=\"deepfake-label-title\">\n<h3 id=\"deepfake-label-title\">Example of a disclosure label<\/h3>\n<p>\n<strong>Content generated or manipulated using artificial intelligence.<\/strong>\n<\/p>\n<p>\nWhere appropriate, the wording can be made more specific, for example: <em>&#8220;AI-generated video&#8221;<\/em>, <em>&#8220;Synthetic voice&#8221;<\/em> or <em>&#8220;Photorealistic image generated with AI&#8221;<\/em>.\n<\/p>\n<\/div>\n<\/section>\n<section id=\"public-interest-texts\" aria-labelledby=\"public-interest-texts-title\">\n<h2 id=\"public-interest-texts-title\">AI-Generated Text on Matters of Public Interest<\/h2>\n<p>\nArticle 50 also covers text generated or manipulated by artificial intelligence when it is published with the purpose of informing the public about matters of public interest.\n<\/p>\n<p>\nIn such cases, the person using the AI system must disclose that the text has been generated or manipulated by artificial intelligence.\n<\/p>\n<p>\nThis provision may apply, for example, to:\n<\/p>\n<ul class=\"htt-check-list\">\n<li>news and informational articles;<\/li>\n<li>press releases and announcements on public-interest topics;<\/li>\n<li>political or institutional communications;<\/li>\n<li>content relating to health, safety, the environment and the economy;<\/li>\n<li>publications that may influence public debate.<\/li>\n<\/ul>\n<h3>The Human Editorial Oversight Exception<\/h3>\n<p>\nA disclosure may not be required where AI-generated content is subject to meaningful human review or editorial oversight and a natural or legal person assumes editorial responsibility for the publication.\n<\/p>\n<p>\nThis exception should not be interpreted as allowing the automatic approval of any AI-generated text.\n<\/p>\n<p>\nAn organisation should be able to demonstrate:\n<\/p>\n<ul>\n<li>who reviewed the content;<\/li>\n<li>which verification activities were carried out;<\/li>\n<li>who assumes editorial responsibility;<\/li>\n<li>which version was approved;<\/li>\n<li>when the approval took place.<\/li>\n<\/ul>\n<div class=\"htt-warning-box\" role=\"note\" aria-labelledby=\"editorial-oversight-title\">\n<h3 id=\"editorial-oversight-title\">A purely formal human review is not enough<\/h3>\n<p>\nSimply clicking &#8220;Publish&#8221; after a quick read-through does not necessarily constitute adequate editorial oversight. Organisations must assess the purpose of the AI system, the type of content it generates, the context in which that content is published and the role assumed by the organisation.\n<\/p>\n<div class=\"htt-highlight-box\" role=\"note\" aria-labelledby=\"practical-principle-title\">\n<h3 id=\"practical-principle-title\">The key principle<\/h3>\n<p>\nUsing ChatGPT, Gemini, NanoBanana, Claude, Midjourney, Canva or any other AI platform does not automatically trigger the same legal obligations in every situation. Responsibilities change depending on whether the AI interacts with people, generates a deepfake, produces public-interest content or is integrated into a service offered to customers.\n<\/p>\n<\/div>\n<h3 id=\"sme-2-august\">What should an SME do from 2 August 2026?<\/h3>\n<p>\nAt a minimum, an SME should know which artificial intelligence systems are being used within the organisation and for what purposes. The first practical step is to create an inventory of AI systems and AI use cases.\n<\/p>\n<p>\nThe organisation should then:\n<\/p>\n<ul class=\"htt-check-list\">\n<li>identify all AI platforms, accounts and integrations currently in use;<\/li>\n<li>determine who is responsible for using each AI system;<\/li>\n<li>verify whether public-facing chatbots or virtual assistants are deployed;<\/li>\n<li>review how AI-generated images, audio, video and text are published;<\/li>\n<li>define who reviews and approves AI-assisted content;<\/li>\n<li>provide staff with AI training appropriate to their roles and responsibilities;<\/li>\n<li>document the measures that have been implemented;<\/li>\n<li>review contracts and terms of service with AI providers.<\/li>\n<\/ul>\n<p>\nFor SMEs using AI solely as an internal productivity tool, compliance obligations may remain relatively limited. However, organisations must still promote AI literacy among staff and comply with applicable legislation relating to data protection, confidentiality, copyright and liability. Article 4 of the AI Act applies to both providers and deployers, including SMEs, requiring measures that are proportionate to the specific context and level of risk.\n<\/p>\n<h3 id=\"chatgpt-obligations\">Does using ChatGPT or Claude at work mean the AI Act applies?<\/h3>\n<p>\nYes. Professional use of ChatGPT may fall within the scope of the AI Act. However, this does not mean that every employee entering a prompt must comply with every obligation contained in the Regulation.\n<\/p>\n<p>\nA company using ChatGPT is generally considered a <strong>deployer<\/strong>, meaning a professional user of an AI system supplied by another organisation.\n<\/p>\n<p>\nThe organisation should therefore assess:\n<\/p>\n<ul>\n<li>the purpose for which the AI system is being used;<\/li>\n<li>the type of data entered into the system;<\/li>\n<li>whether the outputs are published or used to support decisions;<\/li>\n<li>whether the content concerns matters of public interest;<\/li>\n<li>whether effective human oversight is in place;<\/li>\n<li>whether staff have received appropriate AI training.<\/li>\n<\/ul>\n<p>\nUsing ChatGPT to improve the wording of an internal email is fundamentally different from using it to automatically publish news articles, screen job candidates or autonomously respond to customers.\n<\/p>\n<h3 id=\"ai-images-linkedin\">Do I need to disclose AI-generated images on LinkedIn?<\/h3>\n<p>\nNot every image created with artificial intelligence requires the same visible disclosure.\n<\/p>\n<p>\nDisclosure becomes particularly important where the image:\n<\/p>\n<ul class=\"htt-check-list\">\n<li>realistically depicts an identifiable person;<\/li>\n<li>portrays an event that never actually happened as though it were real;<\/li>\n<li>artificially alters an authentic photograph;<\/li>\n<li>could reasonably be mistaken for documentary evidence;<\/li>\n<li>falls within the AI Act definition of a deepfake;<\/li>\n<li>is used to inform or influence the public on an important matter.<\/li>\n<\/ul>\n<p>\nFor clearly illustrative, conceptual or abstract graphics, the risk of misleading viewers is generally much lower.
